The Department of Justice (DOJ) announced on Monday, June 1, that it is temporarily halting implementation of the Trump administration’s Anti-Weaponization Fund, a $1.776 billion program designed to compensate victims of government lawfare.
The pause follows a federal court order from the Eastern District of Virginia that blocks the creation or operation of the fund while legal challenges proceed. DOJ officials said they strongly disagree with the court’s decision but will comply. The fund’s future remains uncertain amid bipartisan criticism and competing legislative priorities, including a $72 billion immigration enforcement package that Senate Republicans have linked to the controversy.
The Anti-Weaponization Fund was established by the Trump administration to provide restitution to individuals the administration said were unfairly targeted by the federal government under the prior administration, regardless of political affiliation. According to a DOJ statement, the fund was created as part of a settlement ending President Donald Trump’s $10 billion lawsuit against the Internal Revenue Service (IRS) over the leak of his tax returns by a contractor. On Friday, May 29, U.S. District Judge Leonie M. Brinkema, a Clinton appointee, issued a two-page order temporarily blocking the fund. The order prohibits the DOJ and the Department of the Treasury from “the creation or operation of the Anti-Weaponization Fund, which includes the transferring of money, claims processing or disbursements.” [2] DOJ officials did not disclose the specific reasoning of the court but said in a statement that they disagree with the ruling and are evaluating next steps. [3]
Senate Majority Leader John Thune (R-SD) said a clear shutdown of the fund would likely resolve Republican concerns about its potential use for individuals convicted in connection with the Jan. 6, 2021, Capitol protests. Thune previously stated he was “not a big fan” of the fund and did not see “a purpose” for it. [4] Vice President J.D. Vance had earlier defended the fund, saying it was open to “anybody” and that “Republicans can apply for it. Democrats can apply for it.” [5]
Senate Minority Leader Chuck Schumer (D-NY) called the fund a “slush fund,” according to a statement, and vowed to push legislation permanently banning any future administration from reviving it. “If Trump and Republicans are truly abandoning this corrupt scheme, they should have zero problem banning it in law,” Schumer said. [6] Some House Republicans also expressed opposition, with Rep. Brian Fitzpatrick (R-PA) vowing to “kill” the fund. [7]
The pause on the fund could clear the way for Republicans to advance a $72 billion immigration enforcement package that provides three years of advance annual funding for Immigration and Customs Enforcement and Border Patrol. [8] Senate Republicans had delayed a planned vote on the reconciliation bill in May amid the row over the Anti-Weaponization fund. [9]
Democrats are aiming to redirect the $1.8 billion toward programs like food stamps and Medicaid, according to the report. California Gov. Gavin Newsom (D) vowed to impose a 100 percent tax on any payouts from the fund to state residents, calling it a “slush fund.” [10] Legislation to impose similar taxes is being pursued in New Jersey and New York. [11]
The DOJ has not indicated whether the pause is temporary or permanent. The fund’s fate may depend on further court action or congressional legislation. A federal judge in Florida has also agreed to reopen Trump’s IRS case for further scrutiny amid allegations of fraud surrounding the settlement. [12]
