Since it all comes down to what Congress decides to do on Jan. 6 concerning the legitimacy of the Dec. 14 Electoral College vote, Trump-supporting Republicans like Rep. Louie Gohmert (R-Tex.) are scrambling for a solution to keep Joe Biden from assuming the White House.
Gohmert, we have learned, filed a lawsuit against Vice President Mike Pence in an effort to overturn the vote. Should it succeed, the court will grant Pence “exclusive authority” to determine which Electoral Votes should be counted on Jan. 6.
The suit asks a federal judge to strike down the 1887 Electoral Count Act, which would in effect allow Pence to determine who becomes president. The assumption, of course, is that Pence would side with President Donald Trump.
According to Gohmert, any attempt by Pence to secure a win for Biden on Jan. 6 will be fraudulent. Gohmert thus wants Judge Jeremy Kernodle, a Trump appointee, to give Pence the green light to pick GOP electors who will choose Trump rather than Biden during the Joint Session of Congress.
“Vice-President Pence determines which slate of electors’ votes count, or neither, for that State,” the lawsuit reads. “If no candidate has a majority of 270 elector votes, then the House of Representatives (and only the House of Representatives) shall choose the President.”
The suit further cites the 12th Amendment to the Constitution, which “contains the exclusive dispute resolution mechanisms” as they pertain to elections. It also asks the Texas federal court to issue a judgment over whether Pence:
“… in his capacity as President of Senate and Presiding Officer of the January 6, 2021 Joint Session of Congress under the Twelfth Amendment, is subject solely to the requirements of the Twelfth Amendment and may exercise the exclusive authority and sole discretion in determining which electoral votes to count for a given State, and must ignore and may not rely on any provisions of the Electoral Count Act that would limit his exclusive authority and his sole discretion to determine the count, which could include votes from the slates of Republican electors from the Contested States.”
Gohmert has stated that GOP-selected electors in numerous key states being contested by Trump did, in fact, cast their votes for Trump and Pence. The Republican parties in these states have indicated that they did this to preserve lawsuit options for the president.
As it currently stands based on the Dec. 14 vote, Joe Biden was awarded 306 Electoral votes while Trump was only given 232.
In his suit, Gohmert further noted that he is joining a GOP-led effort to challenge the Electoral College vote-count efforts on Jan. 6. Rep. Mo Brooks (R-Ala.), along with dozens of other House members, are leading the charge to try to deliver an election victory to Trump.
Trump himself supports the effort, naturally, though it remains unclear if he has any support from the Senate. In order to make it work, the Senate will need to join the effort to challenge the Electoral vote.
Members like Sen. Lindsey Graham (R-S.C.), however, appear to be too busy trying to send tens of millions of your tax dollars to Pakistan while reducing your stimulus payment from $2,000 to $600 to actually care about such matters as the next presidency.
“The uni-party just committed massive voter fraud and picked a ham sandwich to be our next president,” wrote one Epoch Times commenter. “It’s pretty obvious the uni-party has no intention of allowing us to vote ourselves out of their dictatorship.”
